Terms of Service
Victoria's Shabby Cottage offers a wide variety of styles for Web Design including Victorian, Shabby Chic, Cottage, Vintage, Scrapbook, French Chic, Paris Chic, Romantic, Feminine and Girly, Altered Art, Retro and Modern. We use vintage graphics, buttons, jewelry, textiles and and all sorts of unique items and ephemera in our designs. Our custom design services can be untilized to incorporate your own original artwork into your website design as well. All website design services and images provided by Victoria's Shabby Cottage are subject to the following terms and condition. Payment for your design is acceptance of these terms and conditions.
Merchant Moms, PappaShop, Eco Chic, Mia Shops, LTB Web Designs, Shoppe Pro or any other hosting site will not be held responsible for any agreement or contract you have with Victoria's Shabby Cottage. Web Hosting is a separate and independently owned business.
Charges
All custom design services require payment prior to commencement of work. Once final design is approved design will be installed FREE on your hosting site as long as your hosting site is one listed as being compatible with our templates. If you host with any other website you or someone from that hosting service is responsible for adapting and uploading your design template.
If Victoria's Shabby Cottage is asked to redesign any element of a ready made website or changes to a custom site after it's been approved the client shall pay any stated fees for extras as described.
By purchasing any of our design products and services you are only purchasing the right to display the material with all credit links remaining in tact. Unless otherwise stated all Victoria's Shabby Cottage's designs are sold "as is" with no color changes or alterations outside of what is described. If you would like changes to a particular design - please e-mail us prior to purchasing the design.
We accept Mastercard, Visa, American Express, and Discover Charge Cards through Paypal.
Copyright & Design Credit
Victoria's Shabby Cottage retains all copyright privileges on all images and designs unless an image was used that is copyrighted by an outside source such as another artist. You do have permission to use our images for other purposes such as print work but you may not use our images on any online sites such as Ebay or a blog, etc. UNLESS you also show the proper credit link, i.e., Graphics By Victoria's Shabby Cottage and text must be linked to our website url - www.victoriasshabbycottage.com.
Client owns copyright to their own website content. Designs made using an outside source for images such as art by Debi Coules, Jill Serrao, Cherie Perry, or stock photos are subject to copyright laws by that particular artist. The artist retains all copyright to all of the images and the images cannot be used for other purposes without the express written permission of Victoria's Shabby Cottage as approved by the Artist.
Victoria's Shabby Cottage's copyright link must remain at the bottom of client's website design. To remove this link, there is a $150.00 fee to do so and any link from Victoria's Shabby Cottage to your site will be removed immediately.
Victoria's Shabby Cottage reserves the right to use or not use an image of your finished site design on our portfolio page.
Termination & Refunds
Due to the digital nature of our design services, we are unable to issue refunds. There are no exceptions to this policy as our time and work cannot be refunded to us. By purchasing any design, ready made or custom, you are agreeing to this policy and you will have to check a box in the shopping cart noting your agreement to this policy before you will be able to check out.
If you have purchased a design and will not be using the design you have purchased we will be happy to re-list the design on our site to try and sell it for you. If purchased then payment will be made to you minus a $50 fee for us to re-customize and set up the design on someone else's site. You may tell us what price you would like to get for your design and we will add our fee on top of that for listing.
Victoria's Shabby Cottage reserves the right to refuse service to anyone based on our own judgement. Sites suitable for the general public only please.
Victoria's Shabby Cottage reserves the right to terminate any working contract with any client to be found in violation of any of the terms stated herein. If any client is found to be in violation of our Terms of Service your design will be removed from your website immediately.
Indemnification
Under no circumstances will Victoria's Shabby Cottage be liable for any direct, indirect, incidental, consequential or punitive damages resulting from client's website sales or lack thereof. Client is responsible for adding and promoting their own products and/or services.
Victoria's Shabby Cottage is NOT liable for any agreements you have with your hosting service and under no circumstances will Victoria's Shabby Cottage be held liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your relationship with any hosting site, cancellation or removal by your hosting site for not abiding with their terms and conditions.
